The New CONtract on America

And with thunderous applause, Kudlow is having a Cramergasm, and the banksters all rubbing their hands like Mr. Potter from “It’s a Wonderful Life”, Bush announced the most obvious, stupid and mindless nonsense since Carter threatened the Soviet Union for invading Afghanistan. The original “Contract With America” was a noble idea but as usual the political class had no clue and the American people have been in revolt and disgust ever since the politicians betrayed their trust. So now, a new “CONtract on America” has been developed where those who play by the rules will once again donate their hard earned future earnings to cover for those who have no self-responsibility and no shame. While this blanket statement probably should not apply to all of the subprime “victims” we see paraded on the news every stinking night now, the majority fit this rule. And we are being conned again by the political and financial elites.

The idea that people who can not afford their mortgages when their variable rate mortgages increase can be bailed out because the government urged the banksters to “freeze” the adjustable rate increases is so preposterous, so ignorant, and so Hooverian (my word, better give me credit for using it) that the American people who needed hope will soon find out that they have been given more of the same. Banksterism 101 teaches you that the local banker is no longer your primary contact for doing business when it comes to your sub-prime mortgage issues, that the government will eventually bail you out, and that those pesky eviction and auction notices on your door are just legal fluffernuttery to be ignored until Momma and Papa government come to save you. A funny thing happened though on the road to recovery, salvation and keeping your dog Fluffy playing in the backyard; someone forgot that dirty word “qualifications” in the mainstream financial media and the proclamation that 250,000 homeowners might save their homes is such wonderful news, the fact that another 2.5 million might lose theirs has been lost in the Fast Money ticker of joy and happiness. You see, reality is the one thing people refuse to confront and wow, this plan does everything to avoid confronting reality and guaranteeing that the banksters get those Christmas bonuses and a chance to pump and dump their holdings before the house of cards collapses.

Today’s announcement claimed once again, falsely, that the “mortgage crisis” is nothing but a subprime issue. The reality is that the majority of the problems are now growing in the heart of the middle class where Alt-A, traditional jumbo, Option-ARM’s and just regular good old prime mortgages are in trouble. Toss in a dose of home equity defaults, credit card defaults and auto loan delinquencies and you have the formula for a complete meltdown of the entire financial system. While the mainstream media has kept their focus on the residential housing dilemma, the commercial real estate market is following suit. The word is that “gasp” there really is an economic slowdown and a lot of commercial real estate is going unsold, unfinished and unpaid for. This is creating an entirely new aspect for the government to bail folks out. And that’s where the problem in the solution lies. The issue that most people are willing and sadly somewhat eager to overlook is that a mortgage is a binding contract between two private parties, be they an individual and a bank or a business and financier. History is replete with people and companies who lost fortunes or found misfortune because they failed to read or failed to hire someone to read and interpret a contract. Yet the people who did not plan, the banksters who approved obviously falsified application information (like all those SSN’s of 000-00-0000), and those voters who insisted they could make the payments for two or three years even though their Cadillac Escalade monthly payments were equal to or in excess of their housing payments are all now screaming to breach the basic tenets of contract law. That’s reassuring as hell for a capitalist economy now, isn’t it?

Sadly, there is a precedent for the actions taken today and a reason why the banksters were so willing to accommodate, at least in a photo-op sort of way, the wishes of the political class to sooth the ruffled feathers and prevent the photo ops of single moms having their Christmas trees dragged to the curb on the 24th of this month with six crying kids from their $700,000 home which she got on a subprime ARM with a real income of $40,000 per year (not including government assistance). They bought time, and that’s all for now. But the banksters knew they had no options as on January 8, 1934 the United States Supreme Court voted 5-4 in the case of Home Building & Loan Association v. Blaisdell which upheld a patently anti-capitalist law which the state of Minnesota passed in 1933 called the “Minnesota Mortgage Moratorium Law” which was an attempt to provide protection to farmers and homeowners “during the continuance of the emergency and in no event beyond 1 May 1935.” Needless to say the banksters of the time were furious about this and found their test case but much to their shock and surprise the court shot them down and thus initiated the ideal that government supersedes contract law at will or for the alleged national economic good. The decision included this stunning commentary from Chief Justice Hughes:

“[T]he question is no longer merely that of one party to a contract as against another, but of the use of reasonable means to safeguard the economic structure upon which the good of all depends.”

Despite my reading of the U.S. Constitution over and over again, I never saw anywhere in the Bill of Rights a right guaranteeing that “Failure is Not an Option” and that the U.S. Government can just void any contract it wants between private parties because it wants to safeguard Cadillac ownership. There are legitimate national security issues and yes, I know, numerous cases where private agreements are abrogated for the national benefit and under the guise of the commerce clause, but this case when it was decided in 1934 caused the exact opposite desired effect: Banks failed left and right in Minnesota creating a liquidity and cash crisis which devastated not just the farmers and homeowners it was meant to protect, but the very state and local governments who wanted this law enacted in the first place. The bank failures, farm collapse and industrial base imploding left the local and state governments starved for funding and as a result in worse shape than had the foreclosure process been allowed to cleanse the system.

Needless to say, there is a larger issue, at least in this writer’s mind which is staring everyone in the face and the consequences of nonsense like this and the other various bizarre ideas flowing through state houses to “solve” this “problem” are about to create the very nightmare they thought was cured in the 1930’s. As usual this first step into government meddling is nothing more than the Oprahization of the financial markets to make everyone cry and feel good. But the first consequence will be an almost immediate stifling of new paper coming to the bond markets. Why would anyone write a mortgage contract of almost any sort if they thought the government might over ride the agreement to get Senator Flubbus re-elected? Add in the consequence of the investors wanting to shed the paper now at almost any price, and you’re looking at spreads getting ready to soar into the stratosphere which is where I think the TanManMozillo flies to in his G4 to get that deep dark tan. Now that we’ve shaken the confidence of underwriters, banksters and investors, that should pretty much put another nail in the existing home sales and new home sales starting in the first quarter of 2008 once everyone figures out that their return on investment is based on a roulette wheel formula controlled by Benron Bernanke and his group of Goldman flunkies. To add to the misery, find any one with the guts to put up the capital for large scale commercial condominium projects, as even the Donald has cancelled his project in the Tampa area due to the lack of presales despite his name and the Apprentice winner managing part of the project.

The numerous flaws in the plan without even reading it are so hilarious, it’s not even worth posting the details in this rant, just go to the Wall Street Journal in the morning and enjoy the show. The obvious problem that anyone with two functioning brain cells can see is that even though the banksters have turned thirty year paper into thirty five year paper to guarantee their survival with government backing, this does not cure the myriad of other debts that are incurred when one purchases a home. The idiocy of this program does not address an ARM written on a 125% LTV where the debtor is current in their payments and they used the 25% bonus they received on closing for new cars, vacations, or worse, investments in hedge funds that specialized in MBS paper. This means that those foolish loans could easily be protected and even some of the flippers will find a way to deceive the program as they figured that out originally while the good times were rolling. So now I guess we can start the new bail out programs that I propose to finish saving the real estate industry and our economy:

  1. The Escalade refinancing program. All payments are to be frozen at $50.00 per month for 720 months or until the vehicle breaks down. Only people who have subprime home loans where the payments are current and they voted for Barney Frank, even if they lived in Texas will qualify.
  1. The Property Tax dismissal program. In lieu of the inability of people to pay absurd taxes on bogus assessments which the real estate industry promoted to pump up their balance sheets, the Federal Government will pay all property taxes past due on people who had subprime mortgages where the payments are current and they own at least one ecofriendly minivan. To insure this program is fair, people who actually have savings accounts will be required to forfeit at least 50% of their savings because they must be right wing whacko freaks for actually trying to save money.
  1. The Credit Card Forgiveness Act of 2008: Everyone who has a subprime mortgage where they are current and not in default will have their credit card debt paid by a neighbor who doesn’t use credit cards because they are anti-American scum obviously. To insure that people suddenly do not rush out to get credit cards to evade this program, the banksters have assured us that the ABCP market will seize up thanks the Mortgage rescue plan and there will be no desire for short, intermediate or long term paper to be issued to cover any new credit applications.

While I might be speaking tongue in cheek above, the issues are deadly serious. The Fed has no choice, none at all now, but to flood the markets with cheap credit as quickly as possible to insure the commercial credit markets continue to function. Cheap money must become available for the general public also, as the need for the maximization of consumer debt to keep the balance sheets looking good is now national priority number one (Osama Bin-who?). The phrase “inflate or die” will now become the election year mantra as any sustained period with negative economic reports will guarantee a victory by the other party. The Republicans will once again not only sacrifice principles as usual, but long term economic viability in a desperate attempt to retain power which will multiply the problems by larger and larger factors. This attempt to re-leverage a deflating asset class will be akin to burning money in the streets and in the process burning investors worldwide who will eventually bail out in a more open and rapid fashion. The currency, our beloved dollar, will soon be useless as inflation on goods and services skyrocket while the assets the government is attempting to save sink in value, thus initiating the great flight that is already under way yet under the radar. The lack of a manufacturing base will finally come home to roost and this inability to McDonaldize a recovery from the dwindling expansion will finally wake people up and create a withdrawal of funds from investments nationwide by more and more average Americans. The late comers, as usual, will fly to the safety of gold, silver, and other hard assets to weather the storm, just like their parents did in the 1930’s. Meanwhile the Subprime Generation will be wondering where their next magnetic strip will come from, leaving them bewildered when they are laid off from the shopping mall and unable to seek further government aid to sustain their debtor’s lifestyle. The ultimate ending to this story has not been written yet. But the prospects of a deflationary depression starting in late 2008 are quite possibly staring us in the face, as the ability to honor contracts, be they residential mortgages or MBS, CDO’s or CLO’s, will eventually implode our system and the maybe even the government debt creation machine built upon it. The consequences of our excesses for forty years shall now come home to roost. The time to prepare was yesterday, the time to pray for a miracle is now.

Prepetorial #9: U.R.A.

Officer Carmine Lewis tore the ticket out of his book and asked the elderly man to press hit thumb on the scanner on his ticket book. The old guy sneered and pressed his thumb down on the reader, mumbling under his breath. Lewis then proceeded to take a card out of the back of the book and read the man his rights:

 “Sir, you may pay this fine of 150 Ameros online. Otherwise you are required to show up at the Magistrate’s office on Thursday, December 24, 2015 for your hearing. No attorney will be appointed for you and no attorney will be allowed to represent you at the misdemeanor hearing. If you fail to pay the fine or show up at the hearing, the state will automatically debit your account for 300 Ameros on Friday, December 25, 20151 and a limitation notice placed on your account. Do you understand the rights I have presented to you?”

 The old guy snapped back “yes and I’ve been on this earth for sixty-one years, wounded in both Gulf Wars and now I’m getting fined for flying the flag I swore to defend. Just what the hell is this world coming to?” Officer Lewis sensed the agitation and replied calmly, “sir, I can only enforce the laws. One of your neighbors complained and the Flag Act went into effect on January 1, 2013. The law is quite clear that you must fly all three flags or the new unified flag of the Union. Just as the old man was getting ready to vent some more Lewis’ partner yelled from the car “we have a 580 in progress” which cut the conversation short as Lewis ran back to the squad car.

 After strapping himself in, he answered the call and his partner, a twenty year old French-Canadian proudly proclaimed she had downloaded all of the information on the call and mapped it out. Yvette proclaimed “apparently there is an Intel report that this group may be armed and dangerous Lewis” which did nothing to comfort the twenty-four year old Lewis. As they pulled the car into the neighborhood, the S.W.A.T. group was surrounding the building. The Captain was on the scene and barked out to us “cover the team as they enter, watch the streets for any assistance offered to the perps.” To Yvette and Carmine they knew what this meant; it was a sure sign that snipers might be active in the neighborhood. The Public Safety Officers finished isolating the rest of the neighbors and getting them out of their homes when the thud of the door being collapsed in was heard. The house being breached was about a fifty year old split level home with a full basement which is where the criminals usually hide.  The small Christmas decorations on the windows were the dead giveaway and Lewis thought to himself “yep, a definite 580” when the crying of children disturbed his train of thought. As the children were marched out of the front door, Officer Lewis noticed the Mexican Task Force group watching the proceedings with the Captain. The officers knew what to do and tied the plastic handcuffs around the children’s wrists to insure that they could not drop a grenade or surprise any officers. Another officer took them behind the bomb squad curtains with a MTF officer to strip search and insure the kids would not explode as rumors of such events happening everywhere in this state were posted on every alert board for law enforcement nationwide. Next the women and men were marched out, one at a time, most weeping and praying out loud. We knew none of them had the national IDs as these resisters were a thorn in the new system. After all of them were strip searched and then placed in the “bags”, the pink utility suits which doubled as restraints, the paddy wagons started to show up to haul them all away. Lewis could not resist asking “Captain, how many this time?” The Captain smiled and said “ten children, five women, and eight men. But we’re giving the men to the MTF, they need the practice. The kids go to the school outside of town and the women to the factories.” Lewis, being a relative rookie didn’t quite get it. He asked “practice for what?” The Captain pulled him aside and said “you know, interrogation, prisoner processing and handling, target, whatever. They are hear to learn and there is no use in sending more mouths to feed to the labor camps. They are filled to overflowing now.” Lewis nodded in understanding, smiled and moved back to Yvette who had a puzzled look. She said “so what is it with these people? Do not they know that practicing religion without a license will get a 580 called on them. These Mennonites are so anti-social, I just wish we could find them all and end this once and for all.” Lewis could only look sadly at her and reply “it’s not just the Christians who are a problem, the Jews are even worse. We always have  a pick up in business right before the holidays it seems. Why they can’t  just acknowledge the new church regulations and become part of society is beyond me.” With that, the Fire Department arrived to finish the job. The house would be raised as a practice house for the department after they cleaned out all the loot. And the danger of the cultists would hopefully mark the end of another busy day in their little region in State District  41, formerly part of Southeast Ohio. Business was good now, too good. And the officers were just ready to get off work and grab a beer.

 No, I’m not talking about science fiction from some late night movie in this story. And this is not an economic rant like so much of what I write. I sense a noticeable shift in our nation’s attitudes, like we are becoming ashamed to proclaim the religious ideals of our Founding Fathers and to defend the traditions our nation were founded on. The premise behind this editorial is not just the ultimate fantasy of the political correctness ACLU crowd, but the goal of the Marxist followers. The nation could quite easily deteriorate rapidly into an economic tailspin or political crisis which opens the door to the events described above. If you do not think it is possible, then you need to do a moral checklist on yourself and pray for guidance. Residents of 1921 Hamburg, Germany did not think it could happen their either.

The situation where the Weimar Republic found itself created an economic tailspin which worsened until an authoritarian regime came into power to revitalize the nation and bring “order” out of chaos. The same dilemma happened in Czarist Russia as the concept of “any revolution” would be better than starving, thus opening the door to Lenin and his ilk. As people became less and less responsible for their own actions and abdicated personal responsibility to seek food, shelter and personal pleasures at the expense of morals, the judgment of people will and has throughout history becomes morally stagnant, justifying anything and everything to improve the personal lot of those in power in exchange for perceived personal benefit or freedom. This nation, and the others in North America could easily face such a moral dilemma in the immediate time horizon. The test cases have been held and even though there are moral victories to keep Christmas as a holiday in name only for example, the technocratic machine continues to march forward to keep those of faith in a state of constant defense.

So just what is the “U.R.A.” and what does that have to do with the ongoing moral and religious crisis our nation faces? The “United Republic of the Americas” is just one of many names we could see selected for our grand economic union which will rapidly evolve into a political union to insure order and domestic tranquility. The proposed NAU is not just a threat to our economic freedoms as Doctor Jerome Corsi has so succinctly outlined in his writings, but it will expand beyond that to unify the diverse nations in every aspect of life. The concept and fight against a “National ID” is nothing more than a waste of time, a fallacy, as there is no desire to create such identification, only the technology to expand the idea into something more insidious. The union would require the creation of a new currency and what better way to insure you join up with the program than to force you to carry an “Union ID” with all of your monies located on that one single magnetic strip; unless of course you chose the chip. As you can see in the commercial marketplace the training of the American people is in place to use wireless monies and identification cards issued by banksters nationwide with your photo or thumbprint located prominently on the front. Yet this is not just the “mark of the beast” that many of us have fretted about; it is the control such a system could easily impose. Your freedoms, of movement, of commerce and even religion could easily be added to such a strip on the back of such a card. And that’s where our nation will cease to exist. And the real fear plus the mark begins.

Imagine the day when you  go to your local government office or bank to sign up for this card. You turn in your cash, driver’s license, Social Security, Medicare/Medicaid or other welfare benefits card, all your credit cards and sign on the bottom line. Then you are programmed into the “new” system and the old one just absorbed into a new era of efficiency and convenience. But as the situation becomes so dire, so financially disastrous, the more socialistic or “progressive” thinkers who will be in charge elect to eliminate tax exemptions for all churches except those who have “universal” services to allow preachers, rabbis, imams or witches of all faiths to practice in the houses of worship. Those churches that refuse to comply or become licensed will be deemed “resisters” and taxed out of existence or worse. And your personal religious affiliation will be programmed on to your new “Union ID” to insure you do not attend churches which are not part of the program. The media propaganda machine will be turned on to shame those churches, leaders and flock as some sort of freaks where the “old ideas” are so hateful that more drastic action will eventually be promoted to “eliminate” the problem. As insane as that sounds, I cite “Waco” as my first and only necessary piece of evidence that such actions are not only doable, but successful when initiated with a blanket of media deception. While many dismiss this is as the rantings and ravings of  another right wing loon, it does not take much of a step to figure out the path of least resistance for a society in decline is to find the scapegoats, label them, and deprive them of their freedoms to benefit the “masses.” This is the path I fear we take when we initiate the union of the U.S., Canada, and Mexico. We will sacrifice not only our sovereign rights and freedoms, we will elect to accommodate all beliefs to keep the peace and forever exempt the church from having a political sway or influence in the new world order of political decision making. The International Council of Churches and other such organizations have already taken the first steps by insuring that those beliefs held by traditional religious society are mocked and those followers labeled as extremists or pariahs in the modern world. The media as their willing accomplice will comply to make matters worse and that leaves each of us, as individuals, with disturbing moral decisions to make.

I pray to the Lord that I am wrong, that this is not the path we are taking. But the prevalence of so many former Communist Party officials who used to work behind the Iron Curtain obtaining positions of power in this nation point only to a soon to be implemented Iron Fist approach to anyone who objects to financial, political or moralistic changes to be implemented for the “good” of all societies in the future. Most technocrats who prefer this path insure such actions are put into motion first by reprogramming the children then dividing a society. The expansion and glorification of so many “feel good” religions to accommodate everyone from dope smokers to pedophiles should be your first clue. Divide. Conquer. Remove. The program of the new order descending upon us. Just as the good book said it would.

Should “We the People” Be Concerned? Darn tootin’ we should be…….

This photo is from an article on seekingalpha.com and I forgot all about the history of currency innovations during financial emergencies.  So should we worry about this? Yes. Keep in mind the depth of the crisis we are just beginning to see bubble into the mainstream media and the light of day hitting the cockroaches beneath the surface. I warn everyone now to make preps with hard, real currency as we march into financial instability, be it inflation or deflation, look for the government to “innovate” to bail their buddies the banksters out. Thus the photo and the beginning of a week plus of solid postings now that my travels are over for a while. Stay tuned for Prepetorial #9 this week and I apologize for the prolonged enforced absence. Hopefully my travels will be more limited the rest of this year.
