Boom goes the dynamite.
President Trump apparently is listening to his legal team and Attorney General Sessions by filing for the full en banc hearing at the 9th Circuit Court of Appeals; an action which was previously initiated by one of the judges per a report on Friday night. From the NY Post:
President Trump plans to appeal the decision that halted his ban on immigration from seven countries, according to a report on Fox Business on Monday.
The 9th Circuit Court of Appeals last Thursday continued a stay on Trump’s executive order that banned travel from seven countries — Iran, Iraq, Syria, Libya, Sudan, Somalia and Yemen.
Lawyers for the federal government and the states that opposed the executive order will discuss the ruling at 6 p.m. Eastern time on Monday, Fox Business reported.
Trump’s lawyers will seek an en banc hearing — meaning the court would select 11 judges at random from a judicial pool of about 30 judges in that circuit to hear the appeal.
This concurs with the action by one of the judges last Friday to clean up the mess that the 3 judge panel made by creating non-existing law while failing to address the legal arguments related to the insane Temporary Restraining Order.
Look for someone with competence and aligned with AG Sessions and President Trump’s viewpoint on the matter of Separation of Powers and Executive Branch responsibilities to represent the government at the en banc hearing instead of another Obama flunky who couldn’t give a crap. The legal arguments will be of supreme importance as this will enable the government to delay a full hearing before the Supreme Court until after Gorsuch is confirmed and the rest of President Trump’s cabinet and subordinate positions are confirmed.
